Payment:
All accounts are due for payment upon receipt, and prior to collection/delivery of documentation, as credit will not be provided. Where accounts remain outstanding any stated discounts will be revoked and an administration fee of $49.50 (inclusive of GST) per month will be applied to the original amount due. In the event of staged works, no works will proceed until progress payments have been made in full. Debts administered by Prushka with collection fee added to total amount.
Pre-Payment:
O’Beirne Design reserves the right, on occasion, to request pre-payment. Where pre-payment is requested, works will not commence until requested payment has cleared.
Alterations to reports:
Once reports have been conducted, any further requested alterations to the reports may be charged at an hourly rate of $99/hr. (inclusive of GST).
Consultation:
Consultations or meetings including professional services or advice outside the scope of works identified at the time of quotation will incur fees at the hourly rate of $99/hr. (inclusive of GST).
Indemnity:
The Client shall not make any demand on O’Beirne Design or commence any legal proceedings against O’Beirne Design and O’Beirne Design shall have no liability, whether in negligence or otherwise, to the Client in relation to any work performed by any consultant engaged by either O’Beirne Design or the Client.
Where the Client provides to O’Beirne design any materials including sketches, photographs, drawings, plans or concepts upon which O’Beirne Design is to base the work, the Client shall indemnify and keep indemnified O’Beirne Design at all times against all actions, proceedings, claims demands, liabilities, either express or implied, and all costs, losses or profit, damages and expenses whatsoever which may be taken against O’Beirne Design or incurred or become payable by O’Beirne Design resulting or arising from any claim or infringement of any patent, registered design, trademark, copyright or any other property or interest of a third party which may result out of the use by O’Beirne Design of the materials.
